Terms of Use

These terms are the agreement between you and us about using Damiano. Please also read our Privacy Policy, which explains what we do with your data.

2. What Damiano is — and what it is not

Damiano is a record-keeping and coordination tool for the adults caring for a baby. It stores what you enter and shows it back to the people you share a Family Space with.

Damiano is not a medical device, and it does not give medical advice. It does not diagnose, treat, monitor or predict any condition. It does not check whether a dose, a feed volume, a growth measurement or a schedule is safe or appropriate. Reminders are conveniences, not clinical alarms: a notification can be delayed or missed by your phone, your network, or the operating system, and you must not rely on Damiano to tell you that a medication is due.

3. Who may use it

You must be 18 or older, or the age of majority where you live, to create an account. Damiano is for adults caring for a child; it is not directed to children and children do not have accounts.

You are responsible for what you do with the account, for keeping your password to yourself, and for the people you invite into your Family Space.

5. Free and paid

Damiano’s daily loop is free, permanently and without a time limit: recording care, all of your history at any range, care plans, appointments, vaccinations, shifts, notifications, offline use, and up to three active caregivers per family.

Damiano Family is an optional auto-renewing subscription that adds unlimited caregivers, the document vault, and data export. It is sold as a monthly or a yearly plan.

What lapsing never does. If a subscription ends, nothing your family recorded is taken away or hidden. Documents already in the vault stay readable and downloadable, every care entry stays visible, and caregivers above the free limit become read-only rather than being removed. Only the paid additions stop — new uploads and new exports.

6. What you may not do

We may suspend or close an account that does these things.

7. Your content

Your family’s record is yours. We claim no ownership of what you enter or upload, and we do not use it to train anything, advertise anything, or build a profile of anyone. We store and process it only to run the service for you, as described in the Privacy Policy. You can export it, and you can delete it.

You give us only the permission we need to operate the service — to store your content, transmit it between your devices and the members of your family, and render it back to you.

8. Our content

The app itself — its software, design, name and logo — belongs to us. Using Damiano does not transfer any of that to you.

9. Availability

We work to keep Damiano running, but we do not promise it will be available without interruption. The app is offline-first: what your family has recorded remains readable on your device when the service or your connection is not. We may change or discontinue features; if we discontinue something you paid for, §5’s store rules and your statutory rights apply.

10. Liability

Damiano is provided “as is”, to the extent the law allows. We are not liable for indirect or consequential loss, for lost data where you have not kept a copy you could have exported, or for any decision about a child’s health taken in reliance on the app — see §2.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or your mandatory rights as a consumer.

11. Ending the agreement

You may stop using Damiano and delete your account at any time. We may end this agreement if you break these terms. Ending it does not by itself delete your family’s record — deletion is the process in Deleting your account.

12. Changes

We may update these terms. If a change matters to you, we will show it in the app before it takes effect and update the date at the top of this page. Continuing to use Damiano after that means you accept the new version.

13. Law and disputes

These terms are governed by the law of Switzerland, without affecting the protections of the consumer law of the country you live in. Nothing here prevents you from bringing a claim in your local courts where the law gives you that right.
